24/01508/FUL Conversion of former childrens nursery into 6 residential units with associated works, car parking and landscaping

The building has been unused since July 2021, when the childrens’ nursery closed. The application proposes conversion to 6 residential units.

While welcoming the conversion in principle, the Society believes the lack of daylight for central flat in the upper storey would be unacceptable, there being no suitable external wall for a conventional vertical window. A revised plan showing only 5 units is suggested as a preferred alternative.

The Society has responded via the “Comments” facility on the EEBC planning website as follows:-

Whilst the application, in principle, given the submitted marketing report that there have been no positive initiatives about a continuance of commercial and community use since July 2021, is supported, and being for a change of use to residential.

ECS also welcomes the removal of the inappropriate 1970’s forward extension thus returning the building to its original front elevation design.

However, there is strong concern about the plans showing the proposed flat No.5.

The design is considered unacceptable by being situated within the roof space therefore having no vertical external walls able to accommodate conventional vertical windows. The natural daylighting is only via roof lights above head height. This design would give a “shut in” existence to the living conditions of the occupiers.

Furthermore, it is considered that this does not fulfil the requirements required (i) by NPPF Chapter 12, requiring well designed places; (ii) by CS5, requiring functional building and (iii) DM10 (ix) providing acceptable daylighting and living conditions.

Refusal is therefore requested in the current submitted form.

ECS believes that a better and more acceptable scheme would be one that delivers five flats thus enabling just two flats constructed to the first floor and not necessitating the rather cramped accommodation shown within the existing second floor layout.
